Please read these Terms of Use ("Terms") carefully before using the Radiara application ("the app"), operated by HDFoundry.

Acceptance of terms

By downloading, installing, accessing, or using the app, you agree to be bound by these Terms. If you do not agree, do not use the app.

Description of service

Radiara is a free internet radio streaming application that lets you discover, browse, and listen to publicly available radio stations from around the world. The app provides a curated station catalog that our team builds and maintains, drawing in part on data from open, community-maintained directories (see Station data and third-party directories below).

Radio content disclaimer

Radio stations and their audio content are provided by independent third-party broadcasters. We do not own, operate, control, endorse, or assume responsibility for any radio station or its content. Specifically:

• We do not host, produce, or edit any audio streams
• Content may include music, talk shows, news, or other material that may not be suitable for all audiences
• Station availability, quality, and content are determined solely by the station operators
• Stations may go offline, change URLs, or become permanently unavailable without notice

Station data and third-party directories

Radiara maintains its own station catalog, which our team curates, enriches, and organizes. To keep this catalog broad and current, the catalog draws in part on data from independent, community-maintained open directories, primarily the Radio Browser project, an open-source initiative whose station database is made available as open data and accessed through a free public API.

• Radiara is an independent application and is not affiliated with, endorsed by, or sponsored by Radio Browser or any radio station, broadcaster, or directory project.
• We access such directories through their public APIs in accordance with each project's published usage guidelines, and we comply with the terms under which their open data is provided.
• Station entries (names, logos, genres, stream URLs, and similar metadata) are contributed by the broader community and may be incomplete, outdated, or inaccurate. We do not guarantee the accuracy, completeness, or availability of any station data.
• The names, logos, and trademarks of the stations and of any directory project belong to their respective owners and are used for identification purposes only.

We may add, change, supplement, or replace the data sources behind our catalog at any time without notice.

Recording for personal use

The app may allow you to record the audio of a stream you are actively listening to, for your own personal, non-commercial, time-shifted listening only (similar to a home recording of a broadcast). By using this feature you acknowledge and agree that:

• Recordings are created and stored solely on your own device. The app does not upload, host, share, publish, or distribute your recordings, and provides no feature to export or share them.
• You may use recordings only for your own private listening. You must not redistribute, broadcast, publish, sell, sublicense, or otherwise make recordings available to any third party, nor use them for any commercial purpose.
• Radio audio is owned by independent third-party broadcasters and their rights holders. You are solely responsible for ensuring that your recording and use of any content complies with applicable copyright laws and the laws of your jurisdiction. Recording may not be permitted for all content or in all regions.
• Recording is offered as a convenience and depends on the stream type; some stations and stream formats cannot be recorded, and availability may change without notice.
• HDFoundry does not own, license, or assume responsibility for any recorded content and disclaims all liability arising from your creation or use of recordings.

User conduct

You agree to use the app lawfully and responsibly. You shall not:

• Use the app for any unlawful purpose or in violation of applicable laws
• Attempt to interfere with, disrupt, or overload the app or its connected services
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the app
• Use automated tools such as bots or scrapers to access the app or its data
• Redistribute, sublicense, or commercially exploit the app without our written consent

Intellectual property

The Radiara app, including its design, code, trademarks, and brand assets, is the property of HDFoundry and is protected by applicable intellectual property laws. Radio station names, logos, and audio content belong to their respective owners.

No account required

The app does not require you to create an account or provide personal information. All preferences and data are stored locally on your device.

Availability and service interruptions

We strive to maintain availability but do not guarantee uninterrupted, secure, or error-free operation. The app may be temporarily unavailable due to maintenance, third-party service outages (Radio Browser API, streaming servers), network issues, or force majeure events.

Disclaimer of warranties

The app is provided as is and as available without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, timely, secure, or error-free.

Limitation of liability

To the maximum extent permitted by applicable law, HDFoundry shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or business interruption, arising out of or in connection with your use of the app.

Indemnification

You agree to indemnify and hold harmless HDFoundry from any claims, damages, losses, or expenses arising from your use of the app or violation of these Terms.

Third-party links and services

The app may contain links to third-party websites or services such as station homepages and app stores. We are not responsible for the content, privacy policies, or practices of any third-party services.

Modifications to the app

We reserve the right to modify, suspend, or discontinue the app or any part of it at any time without notice, and shall not be liable to you or any third party for doing so.

Governing law

These Terms are governed by applicable law, without regard to conflict of law principles. Any disputes shall be resolved in a court of competent jurisdiction.

Changes to these terms

We may revise these Terms at any time by posting the updated version on this page, with the date above updated accordingly. Continued use of the app after changes constitutes acceptance of the revised Terms.
