Terms of Service

By downloading, installing, or using Scanly (the "app"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the app. These Terms constitute a legally binding agreement between you and HDFoundry, the developer of Scanly. If you are using Scanly on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Description of service

Scanly is a free mobile application that lets you scan QR codes and barcodes using your device camera or photo library to retrieve publicly available product information. The app retrieves data from third-party open databases, including Open Food Facts, Open Beauty Facts, Open Products Facts, Open Library / Internet Archive, and UPCitemdb. Scanly keeps your scan history on the device until you clear it or uninstall the app; retrieved product details are additionally cached on the device for 48 hours so repeat lookups are fast. The app is provided free of charge and does not require account registration.

Accuracy disclaimer

Important, please read carefully. All product information displayed in Scanly is sourced from third-party open databases contributed by members of the public. We do not independently verify, curate, or guarantee the accuracy, completeness, timeliness, or reliability of any product information. Specifically, you acknowledge and agree that:

  • Product data may be incomplete, outdated, incorrect, or missing entirely
  • Ingredient lists may not reflect the current product formulation
  • Nutrition information may contain errors or may not apply to all regional variants of a product
  • The app is not intended to be used as a sole source for medical, dietary, allergy, or safety-related decisions
  • The app is not a substitute for reading the actual label and packaging of any product
  • You should always verify product information with official sources, especially if you have food allergies, intolerances, medical conditions, or other health concerns

We expressly disclaim all liability for any harm, injury, loss, or damage arising from reliance on product information provided by the app.

Permitted use

Scanly is licensed to you for personal, non-commercial use only. You agree that you will not:

  • Use the app for any commercial purpose without our prior written consent
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the app
  • Remove, alter, or obscure any proprietary notices within the app
  • Use automated means, bots, scrapers, or scripts to access the app or any third-party database through the app
  • Use the app in any manner that could damage, disable, overburden, or impair our services or the third-party databases we rely on
  • Attempt to gain unauthorized access to any systems or networks connected to the app
  • Use the app to violate any applicable law or to infringe upon the rights of others

Intellectual property

The Scanly application, including its design, interface, logo, branding, code, and documentation (excluding third-party product data), is the exclusive property of HDFoundry and is protected by applicable intellectual property laws. Product data retrieved by the app is sourced from third-party databases and is subject to their respective licenses (for example, Open Food Facts data under the Open Database License, and Open Library data under Creative Commons and other open licenses). Any rights not explicitly granted are reserved by HDFoundry.

Disclaimer of warranties

The app is provided on an as is and as available basis, without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including implied warranties of merchantability and fitness for a particular purpose, warranties of non-infringement, warranties that the app will be error-free or secure, and warranties as to the accuracy of any product information.

Limitation of liability

To the maximum extent permitted by applicable law, HDFoundry shall not be liable for any indirect, incidental, special, consequential, or punitive damages, loss of profits or data, or damages arising from your use of or inability to use the app or from reliance on product information. Because Scanly is offered free of charge, our aggregate liability to you shall not exceed USD 10.00.

Advertising

Scanly is free to use. To support it, future versions may display advertising provided by third-party networks such as AppLovin. Ads are kept separate from product content, and your use of any advertiser website or offer is governed by that third party's own terms and privacy policy, not ours.

Third-party links and services

The app may contain links to third-party websites, services, or resources, provided for convenience only. Your use of any third-party services, including the product databases listed above, is subject to their own terms and privacy policies. Inclusion of any link does not imply endorsement by HDFoundry.

Termination

We reserve the right to terminate or suspend access to the app at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful. You may stop using the app at any time by uninstalling it. Provisions that by their nature should survive termination will survive, including intellectual property provisions, warranty disclaimers, and limitations of liability.

Governing law

These Terms are governed by applicable law, without regard to conflict of law principles. Any disputes shall be resolved in a court of competent jurisdiction. If any provision is found unenforceable, it shall be limited or eliminated to the minimum extent necessary so the remaining Terms remain in effect.

Changes to these terms

We reserve the right to modify these Terms at any time. If a revision is material, we will make reasonable efforts to provide notice through an in-app notification or by updating the date above. By continuing to use the app after revisions become effective, you agree to be bound by the revised Terms.
